Terms & Conditions of Service

REGISTRATION TERMS

Please read the following terms and conditions carefully to ensure that you are fully aware of your rights and obligations when registering for a Sustainable eCommerce package (Package), via our website located at www.sustainable-ecom.com or gilesasmith.com (the Website).

Your registration for interest in one of our Packages signifies your agreement to be bound by these terms and conditions (these Terms), which constitute a contract between Whiz Technology Pty Ltd trading as Sustainable eCommerce (A.B.N. 87 605 269 038) and You.

Sustainable eCommerce may, from time to time, vary these terms and conditions and will provide notification via our Website. All amendments will be effective immediately upon a notification being displayed on our Website.

Registration

You will only be able to access content relating to any Package, which you have registered and paid for.

You must provide complete and accurate details at the time of registering for a Package. You may be required to provide additional details upon our request to ensure the accuracy of your registration.

All registrations to a Sustainable eCommerce Package, or for a Free Consultation towards one of our Packages must be made via our Website.

Purchase Price

All prices displayed on our Website are in Australian Dollars (AUD) and include Goods and Services Tax (GST). International orders will not contain GST.

We reserve the right to vary the prices displayed in connection with any Packages, from time to time, and without notice to you.

Payment

You may pay for a Package via any payment method stated as being accepted on our Website, or via any other payment method that we agree to accept.

Once we have received your full payment for a Package in cleared funds, we will confirm your registration and provide you with relevant updates leading up to the Package that you have registered for.

Non-payment

Your non-payment of any amount required to be paid to Sustainable eCommerce, to access a Package, will result in your access to the Package being suspended or terminated.

Cancellation of Registrations

Cancellation by you

You may cancel your registration to a Package at any time, provided you give Sustainable eCommerce 30 days’ written notice, or otherwise follow the terms of the Cancellation Policy detailed in our Services Agreement with you.

Cancellation by Sustainable eCommerce

We may cancel your registration for a Package, if for any reason, we are unable to conduct the services you are registered for. We will provide you with a full refund of the purchase price for the Package for any current month that we are unable to provide services to you. 

You will not be entitled to claim any additional amounts or seek compensation for any loss, expense or damage (either direct or consequential) or for any loss of time or inconvenience, which may result from our cancellation of a Package.

Refunds

All fees paid in association with your registration in a Package are non-refundable, unless we are required to make a refund under the Australian Consumer Law.

Please email us if you feel that you are entitled to receive a refund from us.

Intellectual Property

All material contained in, or connected with, the Sustainable eCom Packages owned or under licence by Whiz Technology Pty Ltd and protected by Australian and international laws.

Your participation in a Package does not grant you a licence or act as a right of use of any of the materials, or trade marks or logos, whether registered or unregistered, contained in, or connected with, a Package without the express written permission of Sustainable eCommerce.

Sustainable eCommerce owns the copyright, which subsists in all creative and literary works that are contained in, or connected with, a Package.  subject to certain works being under licence. You must not:

reproduce or use any of the material contained in, or connected with, a Package; or

in any way modify the material contained in, or connected with, a Package.

In summary, you must not modify, copy, reproduce, republish, frame, upload to a third party, post, transmit or distribute any material or trade mark connected with a Package in any way except as expressly provided for by contained in, or connected with, a Package.

Enforcement of our intellectual property rights

Sustainable eCommerce will not, under any circumstances, tolerate infringement of its intellectual property, whether such infringement is inadvertent or otherwise. In the event that you do any of the prohibited acts as listed above or infringe upon its intellectual property in any other way, Sustainable eCommerce will enforce its intellectual property rights against you.

Disclaimer

The information presented in, and contained within a Package is for educational purposes only. It is not intended to constitute legally binding advice. We attempt to ensure that the content is current and accurate, but we do not guarantee its currency and accuracy. You should carry out your own research and/or seek your own advice before acting or relying on any of the information presented in a Package. You acknowledge, accept and agree that by registering for the Package, you are fully responsible for your progress and the results derived from your participation in a Package. As you would be aware, the results achieved vary from person to person depending on personal attributes and/or objectives. Therefore, we offer no representations, warranties or guarantees, verbally or in writing, regarding your performance or any certain results (financial or otherwise) that you may or may not achieve as a consequence of your registration or participation in a Package.

Liability

To the extent permitted by law, including but not limited to any act or omission on your part, we will not be liable for any loss, damage, costs or expense whether direct, indirect, incidental, special and/or consequential, including loss of profits, suffered by you or claims made against you which result from any use or access of, or any inability to use or access, information relating to a Package.

Severability

If any provision of these Terms should be held to be ineffective in any way or unenforceable it shall be severed and the remaining provisions shall not in any way be affected or impaired and these Terms shall be construed so as to most nearly give effect to the intent of the parties as it was originally executed.

Dispute resolution

Neither party will start arbitration or court proceedings in respect of a dispute arising out of these Terms, unless the parties have first used their own best efforts to resolve the dispute.

Non-disparagement

Each party to these Terms agrees to not make any disparaging remark or comment about the other, either during these Terms, or beyond termination of them.

Privacy

All personal information that we collect about you will be handled, treated and stored in accordance with the Privacy Policy. By agreeing to these terms and conditions, you are also agreeing to our Privacy Policy.

Consent

By agreeing to these terms and conditions, you also consent to receive further electronic communications from us in relation to the Sustainable eCommerce business, including information relating to course offerings, competitions, promotions, special offers and any other commercial message. Of course, you may email us at any time to unsubscribe from receiving electronic commercial messages from us.

Governing Law

The laws of New South Wales, Australia govern these terms and conditions.
